مادة 511
تُرْسِلُ طَلَبَاتُ التَّعَاوُنِ الْقَضَائِيِّ الدَّوْلِيِّ فِي الْمَسَائِلِ الْجِنَائِيَّةِ الْوَارِدَةِ مِنَ الْجِهَاتِ الْقَضَائِيَّةِ الْأَجْنَبِيَّةِ عَبْرَ الطَّرِيقِ الدِّبْلُومَاسِيِّ إِلَى وِزَارَةِ الْعَدْلِ مُتَضَمِّنَةَ مُلَخَّصَ الْوَاقِعَةِ، وَنَوْعٌ وَمَوْضُوعُ الطَّلَبِ الْمُتَرْجِمِ إِلَى اللُّغَةَ الْعَرَبِيَّةَ.
وَيَجِبُ أَْنْ يُرْفِقُ بِالطِّلَبِ الْمُسْتَنَدَاتِ الْمُؤَيِّدَةِ لَهُ.
وَتَتَوَلَّى وِزَارَةُ الْعَدْلِ التَّحَقُّقَ مِنْ مُدَى تَوَفُّرِ الشُّرُوطِ الْمُبَيَّنَةِ بِالْفَقْرَةِ الْأولَى مِنْ هَذِهِ الْمَادَّةِ، وَلَهَا أَنَّ تَتَّخِذُ أيًا مِنَ الْإِجْرَاءَيْنِ الآتيين:
أَوََلَا: حِفْظُ الطَّلَبِ إِذَا تَبَيُّنٍ لَهَا عَدَمُ تَوَفُّرِ الشُّرُوطِ الْمُشَارَ إِلَيْهَا مَعَ إِخْطَارِ الْجِهَةِ الطَّالِبَةِ بِأسْبَابِ الْحِفْظِ عَبْرَ الطَّرِيقِ الدِّبْلُومَاسِيِّ.
ثَانِيًا: إِحَالَةُ الطَّلَبَاتِ الْمُسْتَوْفَاةُ لِلشُّرُوطَ الْمُشَارَ إِلَيْهَا إِلَى النِّيَابَةِ الْعَامَّةِ لِإعْمَالَ شئونها طِبْقًا لِأَحْكَامَ هَذَا الْكِتَابِ.
Article No. 511
Requests for international judicial cooperation in criminal matters received from foreign judicial authorities are sent via diplomatic channels to the Ministry of Justice, including a summary of the incident, and the type and subject of the request translated into Arabic.
The application must be accompanied by supporting documents.
The Ministry of Justice shall verify the availability of the conditions stated in the first paragraph of this article, and may take either of the following two actions:
First: The application shall be rejected if it becomes clear that the conditions mentioned are not met, while notifying the requesting party of the reasons for rejection through diplomatic channels.
Second: Referring applications that meet the aforementioned conditions to the Public Prosecution to carry out its affairs in accordance with the provisions of this book.
