مادة 232
يَنْشَأُ بِدَائِرَةٍ كُلَّ مَحْكَمَةِ جُزْئِيَّةِ مَرْكَزٍ لِلْإعْلَاَنَاتِ الْهَاتِفِيَّةِ يَتْبَعُ وِزَارَةُ الْعَدْلِ يَخْتَصُّ بِالْاِسْتِعْلَامِ مِنْ قِطَاعِ الْأَحْوَالِ الْمَدَنِيَّةِ عَنِ الرَّقْمِ الْقَوْمِيِّ لِلْمُتَّهَمَ وَرَقْمَ الْهَاتِفِ الْمَحْمُولِ الْمُثَبَّتِ بِهِ، وَفْقًا لِلنَّظْمَ وَالْقَوَاعِدَ الْمَعْمُولَ بِهَا فِي قِطَاعِ الْأَحْوَالِ الْمَدَنِيَّةِ وَبِمَا لَا يَتَعَارَضُ مَعَ مُقْتَضَيَاتِ الْأَمْنِ الْقَوْمِيِّ وَسُرَيَةِ قَوَاعِدِ الْبَيَانَاتِ الْقَوْمِيَّةِ، وَإِرْسَالَ الْإعْلَاَنَاتِ الْهَاتِفِيَّةِ وَالْإلِكْتُرونِيَّةِ وَإِعْدَادِ تَقْريرٍ بِمَا يُفِيدُ اِسْتِلَامُ تِلْكَ الرَّسَائِلِ.
وَيُقَدِّرُ الْقَاضِي الْمُخْتَصُّ الرَّسْمَ الْمُسْتَحِقَّ عَلَى الْإعْلَاَنِ الْهَاتِفِيِّ وَفْقًا لِحُكْمَ الْمَادَّةِ 16 مِنَ الْقَانُونِ رَقْمَ ٩٠ لِسَنَةً ١٩٤٤ بِشَأْنِ الرُّسُومِ الْقَضَائِيَّةِ وَرُسُومِ التَّوْثِيقِ فِي الْمَوَادِّ الْمَدَنِيَّةِ، عَلَى أَْنْ يَلْزَمُ بِأَدَائِهِ مَنْ يَحْكُمُ عَلَيْهِ بِالْمَصَارِيفِ الْجِنَائِيَّةِ.
وَيُخَصِّصُ الرَّسْمُ الْمُشَارُ إِلَيْهِ بِالْفَقْرَةِ الثَّانِيَةِ مِنْ هَذِهِ الْمَادَّةِ لِلْإِنْفَاقَ عَلَى تَطْوِيرِ مَرَاكِزِ الْإعْلَاَنِ وَإِعْدَادِ قَوَاعِدَ الْبَيَانَاتِ اللَّازِمَةِ.
Article No. 232
Each district court shall establish a telephone advertising center affiliated with the Ministry of Justice, which shall be responsible for inquiring from the Civil Status Department about the national number of the accused and the mobile phone number registered therein, in accordance with the regulations and rules in force in the Civil Status Department and in a manner that does not conflict with the requirements of national security and the confidentiality of national databases, and for sending telephone and electronic advertisements and preparing a report confirming the receipt of those messages.
The competent judge shall determine the fee due for the telephone announcement in accordance with the provisions of Article 16 of Law No. 90 of 1944 concerning court fees and documentation fees in civil matters, provided that it is obligatory for the person who is ordered to pay the criminal expenses to pay it.
The fee referred to in the second paragraph of this article is allocated to spending on the development of advertising centers and the preparation of the necessary databases.
