UNESCO Guidelines for the Use of AI Systems in Courts and Tribunals

1. Principles

Organizations and individual members of the judiciary should follow thirteen principles when adopting and using any type of AI system, including generative AI tools:

1.1. Protection of human rights: Adopt AI systems grounded in respect for human rights that allow the judiciary to respect, protect, and promote human rights while administering justice. 16 While all human rights that may be potentially affected by AI systems should be considered along the life cycle of these tools, the following four points are particularly important in the context of judicial proceedings: 

a. Fairness: Adopt AI systems that aim to attain their goals through processes that safeguard fairness and ensure inclusive technology access.17

b. Non-discrimination: Prevent biased applications of AI systems and outcomes that reproduce, reinforce, perpetuate, or aggravate discrimination. 18

c. Procedural fairness: Assess the implications of AI systems for procedural fairness throughout the AI system’s life cycle and prevent deployments that breach rights to procedural fairness.

d. Personal data protection: Adopt AI systems that protect personal data treated for the administration of justice and deploy tools that contribute to anonymizing udicial decisions. 19 The judiciary should avoid using AI tools in ways that generate risks of disclosing such data or enable unauthorized access by third parties.20

1.2. Proportionality: Adopt AI systems that aim to achieve legitimate and proportional ends in the context of their use. 21

1.3. Safety: Adopt AI systems that avoid, address, prevent, and eliminate unwanted harm.22

1.4. Information security: Adopt AI systems that protect confidential information in line with international standards for access to information. 23

1.5. Awareness and informed use: Understand the functionalities, types of uses, potential impacts, limitations, and risks of available AI systems to make informed decisions about their implementation and be aware of the intended purpose for using a specific AI system to carry out judicial activities. 24

1.6. Transparent use: Inform in a proper and timely manner when and how AI systems are used and how these tools work, especially when decisions made with or based on such tools can affect the rights and freedoms of individuals or communities. 25

1.7. Accountability and auditability: Ensure accountability by informing and explaining why certain AI tools were adopted by the judiciary and ensuring traceability of the AI system’s processes and outcomes, mainly when such tools are used for decisionmaking processes. 26 Undertake administrative, legal, and human measures to ensure that the AI systems may be audited during and after their deployment.27

1.8. Explainability: Adopt AI systems that are transparent in terms of how the system operates, how it was developed, its training data, its limitations (including its margin of error), its capabilities, and the purpose of the systems.

28 Explainability refers to making intelligible and providing insight – to deployers and users – into the inputs, outcomes, and functioning of AI systems, making these elements understandable and traceable for humans.29

1.9. Accuracy and reliability: Adopt and use accurate AI systems, meaning AI systems that can provide useful and pertinent information and produce correct outputs and predictions, 30 and reliable AI systems, meaning AI systems that work “properly with a range of inputs and in a range of situations”.31

1.10. Human oversight: Do not rely exclusively on AI systems to adopt decisions or automate entire processes that may negatively impact the rights and freedoms of individuals or communities, and maintain an appropriate level of human control and involvement concerning all AI systems. 32

1.11. Human-centric design: The development, deployment, and use of AI systems should follow human-centric design principles to complement and augment the judiciary's capacities and respect human dignity and autonomy.33

1.12. Responsibility: Organizations that deploy AI systems and individuals that use AI systems must assume responsibility for the decisions and actions taken with the support of AI tools without prejudice to the provider's potential liability in case the AI system is defective. 34

1.13. Multi-stakeholder governance and collaboration: The organizations that are part of the judiciary should consult diverse stakeholders throughout the AI system's life cycle, especially those that may be directly or indirectly affected by its deployment.

Allow meaningful participation of marginalized groups and incorporate their feedback in the development and use of AI tools used to make judgments or with the potential to impact any other significant legal issue. 35

2. Specific guidance for organizations that are part of the judiciary These recommendations apply to the bodies that govern the judiciary, courts, and tribunals that intend to adopt and use AI systems.

2.1. On the adoption of AI tools:

2.1.1. Conduct algorithmic impact assessments before AI systems are deployed, including human rights and ethical assessments. AI systems that support decision-making processes should be examined through algorithmic impact assessments that identify implications for access to justice and individual rights and potential risks. Such reports may inform whether the systems should be deployed and recommend the appropriate risk prevention, mitigation, redressal, and monitoring measures.36 The algorithmic assessments should be available for public consultation. Algorithmic impact assessment guidelines and instruments, such as UNESCO’s “Ethical Impact Assessment: A Tool of the Recommendation on the Ethics of Artificial Intelligence”, may be used to examine potential impacts on human rights such as fair trial and due process, access to justice and effective remedy, privacy, and data protection, equality before the law, and non-discrimination. 37 These assessments should be done in consultation with the relevant stakeholder groups. 

Finally, other emerging frameworks could be considered for conducting AI algorithmic impact assessments (including some focusing on human rights). 38

2.1.2. Data transparency, quality, and integrity. Adopt AI systems that offer greater transparency of their training data and allow deployers and users to assess the quality and integrity of such data.39

2.1.3. Necessity, proportionality, suitability, and alignment. The necessity, proportionality, and appropriateness of using an AI system to perform tasks should be assessed and established from the outset and aligned with the objectives of the organization using the AI system (e.g., that protects human rights and ensures the judiciary’s independence and autonomy).

2.1.4. Consult with relevant stakeholders. Before adopting AI systems that are used for decision-making or tools that support management processes and that can significantly affect fundamental rights, such as access to justice, the organization should consult with relevant stakeholders about the opportunities, potential risks, and impacts of introducing such tools.

2.1.5. Compliance with the law and compatibility with organizational standards. 

Adopt systems developed and offered in compliance with general principles of international human rights law and local laws, such as data protection and privacy, antidiscrimination, procedural fairness, consumer, competition, and intellectual property laws. Furthermore, when an external provider supplies the AI system, ensure the tool’s terms of use are compatible with local laws and organizational standards of the organizations that govern the judiciary.

2.1.6. Access to key information about AI systems. Obtain information from the AI system’s developers and providers about the tool's adequate uses, the requirements for maintaining its optimal operation, and the limits and risks associated with its adoption. This point may require developers and providers to disclose sufficient information about how the model was developed (including the data used to train it) and how it works. Different transparency instruments, such as model cards, may be considered for providing access to such information. 40 Furthermore, the organizations that are part of the judiciary should adopt explainable AI tools, which refer to systems with the “ability to explain their rationale for decisions, characterize the strengths and weaknesses of their decision-making process, and convey an understanding of how they will behave in the future.”41

2.1.7. Ensure the viability of the algorithmic audits conducted while AI systems are deployed. In the acquisition process and during the implementation process, ensure the developer or provider of the AI system agrees to allow and collaborate with algorithmic audits carried out or commissioned by the organization to external parties (e.g., firms specialized in conducting algorithmic audits that are contracted by the organization of the judiciary). If the AI system was developed internally, ensure the development of the internal capacity to monitor and audit the tool (with external guidance if needed), for example, by establishing “mechanisms that facilitate the system’s suitability, such as ensuring traceability and logging of the AI system’s processes and outcomes.”42 Furthermore, “ establish processes for third parties (e.g., suppliers, consumers, distributors/vendors) or workers to report potential vulnerabilities, risks or biases in the AI system.” 43

2.1.8. Proactively disclose key information about the AI systems used by the judiciary. Publish information about the adopted AI systems, how they operate, how they are used, and the implications when such tools are deployed to automate decisions or support decision-making processes. For example, the bodies that govern the judiciary can publish an online repository with key information about the AI systems adopted to administer justice. The repository can include data on how the AI systems work, who uses the tools, how they are used, and the implications for judicial decision-making processes.44 The information on the repository should be updated periodically, at least on a yearly basis, and it should be clear when the last time that the repository was updated.

2.1.9. Conduct algorithmic impact evaluations of AI systems that have been deployed. Evaluate the effects of the deployed AI systems on users, affected populations, and society. The latter should include evaluating the impact on human rights and identifying the system’s main effects (intended and not intended) over diverse user groups and populations.45

2.2. On internal procedures and standards:

2.2.1. Human intervention. Ensure that the system allows for human intervention. In other words, human control and supervision, or at least monitoring, should occur during all the implementation stages and usage of the AI system.

2.2.2. Risk management systems. Regarding the AI systems that are used in decisionmaking processes, establish a risk management system that enables the organization to identify, detect, monitor, classify, diagnose, control, and prevent risks as well as mitigate harm. The management system should assign clear roles, responsibilities, and procedures along the life cycle of the AI system. In case of defective AI systems or systems that appear to be producing negative effects, the deployment should be suspended while an investigation is conducted.

2.2.3. Cybersecurity-enhancing measures. Adopt technical, managerial, and human measures to prevent, control, and mitigate cybersecurity risks and incidents. When the deployment and use of the AI system entails accessing cloud services, ensure that the level of protection offered by the provider matches local legal standards as well as organizational security standards.

2.2.4. Data governance. Establish a robust data governance framework and infrastructures to protect personal data and promote responsible data-sharing practices for personal and non-personal data. The organization should also establish “data protocols governing data access. These protocols should outline who can access data and under which circumstances. Only duly qualified personnel with the competence and need to access individual’s data should be allowed to do so”46

2.2.5. Publish impact evaluations and performance reports. Carry out continuous and regular risk assessments of AI systems and publish periodic reports on the impactsand performance (e.g. effectiveness and efficiency) of the adopted AI systems in meeting the organization’s objectives.

2.2.6. Enhanced privacy protections. Given the sensitive nature of personal and legal data that is handled in judicial processes, it is essential to have stringent privacy protections in place. (i) Data minimization. To mitigate the risk of data breaches, AI systems that require minimal personal data to function, particularly in cases involving sensitive personal information should be used. Hence, the organizations of the judiciary should deploy AI systems that are based on privacy enhancing processes. 

(ii) Consent protocols. Pursuant with local data protection and privacy laws, draft and implement consent protocols for treating personal data with AI tools within the judiciary. This will ensure that parties are informed and can control how their data is used.

(iii) Data anonymization. Anonymization techniques should be employed when AI systems process personal data, especially in creating databases used for legal analytics or precedent study (e.g., anonymizing the parties’ personal data from court decisions before the rulings are published). 47 However, this should be balanced with the need for having open datasets as well as the right to freedom of expression and access to information so as not to impede the development of digital justice systems.

How these rights are balanced in practice depends on how each jurisdiction regulates the right to access courts documents and anonymization rules derived from data protection and privacy laws. 

2.3. On human talent:

2.3.1. Provide access to training. Offer training opportunities to the members of the judiciary who will use the AI tools and ensure that they develop core competencies of AI literacy, particularly to identify the suitability of AI tools that can be used to carry out different types of tasks, understand how to use these tools and their potential impacts and risks in relation to the international and regional human rights law and national fundamental rights law, and assess their outputs critically.48

2.3.2. Adopt organization-specific guidelines. Adopt context and organizational-specific guidelines on which AI systems can be used, under what conditions, and the accepted and prohibited uses for specific processes and tasks. Moreover, the guidelines should include protocols for incident reporting and clear information on how each actor is accountable within the organization. The guidelines should ensure members of the judiciary acknowledge and take responsibility for any materials they produce using AI.

2.4. On the use of generative AI systems:

2.4.1. Awareness of functions and limitations. Ensure that the members of the judiciary who will use the generative AI tools are aware of the tool's adequate uses, limitations and the risks associated (e.g. biased, incorrect outputs) with their adoption for the drafting of legal documents and supporting participation in legal proceedings, as well as supporting court management activities (e.g. translation). 

2.4.2. Content authenticity and integrity. Ensure the authenticity and integrity of content in the judiciary. To achieve this, several measures should be taken. (i) All AIgenerated legal documents, evidence presentations, or judicial opinions should be clearly labeled as AI-assisted, so that judges, lawyers, and parties involved are aware of the nature of the content. (ii) Robust systems should be implemented to track the development and modifications of AI-generated legal content. This is important for evidentiary purposes, as it ensures that all materials used in court can be verified for authenticity. For instance, if an AI tool has been used to create or modify a legal document, there should be a clear record of when and how it was used. (iii) Certification protocols should be developed for AI tools used in the judiciary, verifying that they meet international and local ethical guidelines as well as each jurisdiction’s legal standards for accuracy and reliability. An example of this could be a certification process for an AI tool that is used to analyze evidence, ensuring that it is accurate and reliable enough to be used in a court of law. 

2.4.3. Usage restrictions. Specific guidelines should be issued to govern the use of generative AI in the judiciary to prevent misuse and protect the integrity of the legal process. Certain applications of AI should be banned or limited considering their impact on human rights. For example, when the terms of use of a generative AI tool indicate that the user’s prompts will be used by the provider to train its models or that third parties can access these prompts, then the use of such tool should be prohibited or restricted to prevent that the judiciary loses control of who can access confidential information or personal data. Moreover, for instance, the use of AI in certain sensitive areas, such as the unilateral generation of binding legal decisions or the creation of fabricated evidentiary material, should be prohibited. Special consideration should be given to intellectual property rights’ compliance by ensuring that any AI-generated content respects the intellectual property of the original text.

3. Specific guidance for individual members of the judiciary These recommendations are applicable to individuals that are part of the judiciary, including magistrates, judges, justices, judicial officers, and judicial support staff.

3.1. Preparation for the use of AI tools:

3.1.1. AI awareness, AI literacy and capacity building. Individuals should be aware of the functionalities, strengths, and accuracy of AI systems and their limitations, biases, and risks in the context of legal activities. The latter also includes awareness of the liabilities arising from these tools' negligent use. The organizations of the judiciary should ensure that individuals have access to education programs and ongoing training to develop critical AI literacy skills. These skills should allow individuals to understand AI fundamentals, identify the functionalities and purposes of diverse AI systems (particularly those deployed in their organization), understand the limits and risks of these tools, learn how to use the AI systems ethically and responsibly, and critically assess the outputs and performance of the tools.49

3.1.2. Use AI tools that have been tested through algorithmic impact assessments. 

As explained in a previous section, the organizations that are part of the judiciary should test AI systems through algorithmic impact assessments, including human rights and ethical assessments. The assessment of AI tools that are meant to support decision-making processes is needed to identify implications for access to justice and individual rights and potential risks. However, if your organization does not assess its AI systems, ensure that you use tested tools (by the provider or expert third parties) and select those that have been the subject of human rights impact assessments.50

3.2. On the use of AI tools:

3.2.1. Avoid overreliance on AI systems to make substantive decisions. Do not rely entirely on AI systems to make decisions on the merits of a case nor to decide on procedural issues that may affect human rights; instead, use AI tools’ outputs to complement the legal analysis undertaken with other methods and sources of information.

3.2.2. Aligned use. If you are allowed to use AI systems that have not been formally vetted by your organization, make sure that the tool reflects intended values and goals of the administration of justice. Ensure that using these AI tools does not jeopardize the organization’s objectives and the human rights of any individual affected by the tool.

3.2.3. Adhere to the terms of use. Read and comply with the AI systems’ terms of use (published by the external supplier of the tool or provided by your organization when the system was developed internally). These terms usually indicate the adequate uses of the tools, the uses that are not allowed or prohibited, and the risks that should be avoided by deployers and users. However, consult with your organization about the terms of use of AI systems, especially if you consider that some terms may unduly restrict users’ rights, deny transparency or absolve developer of any liability.

3.2.4. Transparency. Provide meaningful information on when the AI tool is used and how its use could affect individuals who are part of a judicial proceeding or beneficiaries of the legal work. Inform what tools were used and their versions. Ensure that materials produced or published using AI are acknowledged and distinguished using quotation marks or citations.

3.2.5. Responsibility and accountability. Take responsibility for using AI tools in legal tasks and adhere to standards for accountability in the use of AI developed by your organization. This recommendation implies both an ex-ante duty to disclose the use of an AI system and an ex-post duty to provide further information when required to determine responsibility

3.2.6. Opportunity to review decisions and contestability. Provide parties, interested parties, or clients with an adequate opportunity to challenge and contest decisions taken with or supported by AI systems (e.g., decisions that are informed by the outputs produced by AI predictive tools), as well as basic information of how the AI system works, how it was trained, what inputs were used to operate the system, and how the outputs produced by the AI tool informed the decision.

3.2.7. Proactive reports for preventing harm. Inform the organization when there is suspicion of malfunctioning or potential or likely negative impacts and stop using the AI system if you notice that it creates potential harms on human rights. 

3.3. On the use of generative AI systems:

3.3.1. Protect personal and confidential data. Do not include personal data or confidential information in prompts when using external generative AI tools. 51 Be aware that any information that you input into a public AI chatbot (e.g., as part of the prompt) should be treated as being made available to everyone, among others, because the terms of service of most of the AI companies that provide free access to these AI systems indicate that the inputs will be used to train future models. 52

3.3.2. Main uses for LLMs. LLMs may be used for different tasks including, but not limited to, drafting basic legal documents, writing speeches and presentations, summarizing, translating, making grammatical corrections, modifying the tone of a text (e.g., informal to formal), improving its readability, exploring specific topics, and carrying out administrative tasks (e.g., drafting emails). 53 However, all the previous tasks involve verifying the AI system’s output and cross-checking with reliable sources. AI tools can assist in locating material that you are familiar with and can evaluate on your own. On the contrary, these tools are ineffective means of researching to find information you cannot assess independently. 54

3.3.3. Unreliability as search engines and for legal analysis. Commercial generalpurpose LLMs are not reliable sources of information or adequate means for conducting legal analysis or carrying out mathematical tasks. “Even with the best prompts, the output may be inaccurate, incomplete, misleading, or biased.”55

3.3.4. Awareness of LLMs’ limitations and risks. Be aware that the outputs generated by current LLMs may include incorrect, imprecise, or fictitious information about factual, legal (laws and case law), and technical issues. LLMs can produce answers that lack any reference to the real world and nonsensical text. 56 Moreover, members of the judiciary should be conscious of potential bias in the text produced by LLMs: “Imbalances in the training data can also lead to biases in the model.”57 Additionally, certain LLMs may have been trained on data up to a certain point in time (e.g., data available up to the point when they were last trained). Therefore, information about recent legal cases, laws, and facts may not have been included in the training data; thus, the output produced by the LLM-powered chatbot may be outdated or inaccurate.

3.3.5. Verify outputs before using them. The convincing structure of the text produced by an LLM should not lead to excessive trust in the factuality and veracity of the output.58 “For various reasons, LLMs offer no guarantees regarding the factuality, quality, and desired formatting (e.g., specific code format) of their outputs.”59 Therefore, avoid excessive trust in AI tools by always ensuring that the output generated by generative AI systems is verified and contrasted with reliable sources of information before its use in legal materials and documents.

3.3.6. Transparent use. Disclose the use of generative AI systems for drafting text – rulings, opinions, and other documents that may have legal consequences – or when it is explicitly used in court hearings. For that purpose, distinguish the text produced by the AI chatbot used in a decision by employing quotation marks and a citation system.60

3.3.7. Integrity. Do not attribute synthetic text as your own. Additionally, the members of the judiciary should prevent potential infringements of copyright and intellectual  property rights associated with the use of content produced by generative AI systems.

3.3.8. Responsibility. Take responsibility for using the output produced by generative AI systems to draft rulings and judicial decisions, as well as to inform your participation in court hearings.

أصـدرت الحكـم التـالي

بعد الاطلاع على الأوراق في الملف الالكتروني للطعن وسماع التقرير الذي أعده وتلاه بالجلسة السيد القاضي المقرر/ محمود عبد الحميد طنطاوي، وبعد المداولة. 

حيث إن الطعن استوفى أوضاعه الشكلية. 

وحيث إن الوقائع على ما يبين من الحكم المطعون فيه وسائر الأوراق تتحصل في أن البنك المطعون ضده (بنك أبوظبي التجاري "حالياً" بنك الإتحاد الوطني "سابقاً") أقام الدعوى رقم (1115) لسنة 2022 تجارى مصارف جزئي بتاريخ 29/12/2022م، بطلب الحكم بإلزام الطاعن ( طه محمد حسن صالح زمنكال) بأن يؤدى له مبلغ (750،856.89) درهم، بالإضافة إلى الفائدة التأخيرية أو القانونية بواقع 10% من تاريخ المطالبة وحتى السداد التام، على سند من أن المدعى عليه امتنع عن سداد المديونية المطالب بها سالفة البيان والناتجة عن التسهيلات الائتمانية الممنوحة له من البنك للمدعي، والمتمثلة في: 1- التسهيل الأول: قرض شخصي مؤرخ في 04/03/2008م بإجمالي مبلغ (250،000) درهم بمعدل فائدة 10% على الرصيد المتناقص. 2- التسهيل الثاني: قرض مؤرخ في 04/03/2008م بإجمالي مبلغ (360،000) درهم بمعدل فائدة 11% على الرصيد المتناقص. ولذا فالمدعي يقيم الدعوى. ومحكمة أول درجة قررت بتاريخ 19/1/2023م، بمثابة الحضوري، في مادة تجارية منهية للخصومة، بإلزام المدعى عليه بأن يؤدى للمدعى مبلغًا قدره (750،856.89) سبعمائة وخمسون ألفًا وثمانمائة وستة وخمسون درهمًا وتسعة وثمانون فلسًا، والفائدة القانونية بواقع 5% سنويًا من تاريخ المطالبة وحتى تمام السداد. استأنف المدعى عليه هذا الحكم بالاستئناف رقم (866) لسنة 2026 استئناف تجاري، وذلك بصحيفة مقدمة الكترونيًا بتاريخ 23/03/2026م. ومحكمة الاستئناف قضت بتاريخ 15/07/2026م، منعقدة بغرفة مشورة، بسقوط الحق في الطعن بالاستئناف. طعن المدعى عليه في هذا الحكم بالتمييز بموجب الطعن الماثل بطلب نقضه، وذلك بصحيفة مقدمة الكترونيًا بتاريخ 06/08/2026م. وإذ عرض الطعن على هذه المحكمة في غرفة مشورة حددت جلسة لنظره. 

وحيث إن حاصل ما ينعى به الطاعن على الحكم المطعون فيه مخالفة القانون والخطأ في تطبيقه وتأويله والفساد في الاستدلال ومخالفة الثابت بالأوراق، إذ قضى بسقوط حقه في الاستئناف لرفعه بعد الميعاد، بعد أن أخضع إعلان الحكم الابتدائي المؤرخ 20/02/2023م لأحكام قانون الإجراءات المدنية الاتحادي رقم (11) لسنة 1992 ولائحته التنظيمية، رغم إلغائهما وحلول المرسوم بقانون اتحادي رقم (42) لسنة 2022 محلهما اعتبارًا من 02/01/2023، أي قبل صدور الحكم الابتدائي بتاريخ 19/01/2023م، وقبل اتخاذ إجراء إعلانه بتاريخ 20/02/2023م، ولا يغير من ذلك أن صحيفة افتتاح الدعوى اتخذ إجراء إعلانها بتاريخ 30/12/2022م، لأن إعلان صحيفة افتتاح الدعوى وإعلان الحكم الصادر فيها إجراءان مستقلان، يخضع كل منهما للقانون النافذ وقت اتخاذه، ولا يؤدي خضوع الإجراء الأول للقانون السابق إلى استمرار سريان ذلك القانون على إعلان الحكم الذي تم بعد إلغائه. ولا يعد ما وقع فيه الحكم المطعون فيه مجرد خطأ مادي في الإشارة إلى رقم القانون، ذلك أنه استند صراحة إلى المادتين (152) و(159) من القانون رقم (11) لسنة 1992 وإلى المادة (6) من لائحته التنظيمية، ثم رتب على تلك النصوص صحة إعلان الحكم وسقوط الحق في الاستئناف. فضلًا عن أن الهاتف الذي جرى عليه الإعلان غير عائد للطاعن، وكذا لا يصح إعلان صحيفة الدعوى المؤرخ في 30/12/2022م لمجرد إرسال رسالة نصية إلى رقم هاتف محمول، رغم تمسك الطاعن صراحة بما أثبته المحضر من أن هذا الهاتف يعود إلى شخص آخر، ودون أن يمحص الحكم مستند ?ربط الدعاوى باسم المستخدم? الصادر من نظام محاكم دبي، والثابت منه تسجيل رقم هاتف مغاير للطاعن. إلا أن الحكم اعتبر مجرد إرسال الرسالة من النظام كافيًا للقول بصحة إعلان صحيفة افتتاح الدعوى، والذي بدأ بتاريخ 30/12/2022م ويخضع لقانون الإجراءات المدنية الاتحادي رقم (11) لسنة 1992، ولائحته التنظيمية الصادرة بقرار مجلس الوزراء رقم (57) لسنة 2018، والمعدلة بقرار مجلس الوزراء رقم (75) لسنة 2021، باعتبارها القواعد النافذة وقت اتخاذ ذلك الإجراء. وقد تطلبت المادة (6/2) من اللائحة التنظيمية المشار إليها، في حالة الإعلان بوسائل الاتصال بالتقنيات الحديثة، المنصوص عليها في الفقرة ?أ? من البند (1) من هذه المادة، التأكد من أن وسيلة الاتصال خاصة بالمعلن إليه، كما أن إرفاق محضر القائم بالإعلان بملف الدعوى لم يتقرر لمجرد تتبع المهمة إداريًا، وإنما لتكون الوقائع التي باشرها وأثبتها أثناء تنفيذ الإعلان مطروحة على المحكمة والخصوم، ويعتد بها في الإثبات عند الفصل في صحة الإجراء. وكان الثابت من ملف الدعوى الابتدائية أن القائم بالإعلان أثبت في محضره المؤرخ 02/01/2023، والمرفق بملف إعلان صحيفة الدعوى رقم (224778/2022)، الاتصال الفعلي بالهاتف المثبت في الإعلان وتبينه أن الهاتف يعود إلى شخص آخر رفض ذكر اسمه. ويتعزز ما أثبته القائم بالإعلان بمستند ?ربط الدعاوى باسم المستخدم? الصادر من نظام محاكم دبي بتاريخ 31/10/2022، والثابت منه أن رقم الهاتف المسجل للطاعن في النظام هو: ?0568988369?، كما ثبت من المستند أن حالة الطلب ?مكتمل?، وأنه ?تم تنفيذ المطلوب?، وهو ما يفيد أن نظام محاكم دبي كان يتضمن، قبل اتخاذ إجراء إعلان صحيفة الدعوى، رقم هاتف مغاير للرقم (0508810108) الذي أرسلت إليه الرسالة النصية. ولذا فقد دفع الطاعن بانعدام الخصومة لبطلان إعلانه صحيفة افتتاح الدعوى وعدم انعقاد الخصومة في مواجهته، وكان الثابت من الحكم الابتدائي الصادر بتاريخ 19/01/2023م أن الطاعن لم يحضر أمام محكمة أول درجة، ولم يمثل عنه وكيل، ولم يودع مذكرة بدفاعه، ولا تقوم الإجراءات التي اتخذها الطاعن بعد صدور الحكم الابتدائي مقام الحضور أو إيداع مذكرة الدفاع أمام محكمة أول درجة، لأن منازعته في إجراءات التنفيذ، أو تقديمه التماس إعادة النظر، أو علمه اللاحق بالحكم، جميعها إجراءات تالية على صدوره، ولا تعيد إليه فرصة العلم بالخصومة ومواجهة خصمه وإبداء دفاعه قبل الفصل في أصل النزاع. وإذ خالف الحكم المطعون فيه هذا النظر والتفت عن دفاع الطاعن سالف الذكر فإن الحكم يكون معيبًا بما يستوجب نقضه. 

وحيث إن هذا النعي غير مقبول، ذلك أنه من المقرر في قضاء هذه المحكمة إنه لا ارتباط بين بطلان الإعلان بصحيفة الدعوى وبين بطلان الإعلان بالحكم الابتدائي، فما يسري على أحدهما لا يسري على الآخر، ولذا يتعين عند القضاء بسقوط الحق في الاستئناف لرفعه بعد الميعاد من تاريخ الإعلان بالحكم الابتدائي أن ينصب الطعن بطريق التمييز على بطلان الإعلان بالحكم الابتدائي وليس على بطلان الإعلان بصحيفة الدعوى. وأن النص في البند (1) من المادة (9) من قانون الإجراءات المدنية الصادر بالمرسوم بقانون اتحادي رقم (42) لسنة 2022 على أنه ((يتم إعلان الشخص المعلن إليه بأي من الطرق الأتية: أ- المكالمات المسجلة الصوتية أو المرئية أو الرسائل النصية على الهاتف المحمول، أو التطبيقات الذكية، أو البريد الإلكتروني، أو الفاكس، أو وسائل التقنية الأخرى، أو بأية طريقة أخرى يتفق عليها الطرفان من الطرق الواردة في هذا القانون. ب- ... ج- ... د- ..."، وفي المادة (11) من ذات القانون على أنه ((يعتبر الإعلان منتجًا لآثاره وفقًا للآتي: 1- من تاريخ تبليغه وفقًا للأحكام الواردة في المادتين (9) و(10) من هذا القانون أو من تاريخ رفض المعلن إليه تبليغه. 2- ... 3- ... 4- ...)، يدل وعلى ما جرى به قضاء هذه المحكمة إنه يجوز إعلان المعلن إليه، سواء كان شخصًا طبيعيًا أو اعتباريًا، ولو كان خارج الدولة، بالمكالمات المسجلة الصوتية أو المرئية أو الرسائل النصية الهاتفية على الهاتف المحمول أو البريد الإلكتروني أو الفاكس أو ما يقوم مقامها من وسائل التقنية الحديثة أو بأية طريقة أُخرى يتفق عليها الطرفان، ويعتبر الإعلان منتجًا لآثاره من تاريخ وصول الفاكس ومن تاريخ إرسال البريد الإلكتروني أو الرسائل النصية الهاتفية ومن تحقق المكالمة المسجلة الصوتية أو المرئية. وتقدير مدى تحقق الإعلان بالوسائل الحديثة ومنها الإعلان بطريق الرسائل النصية الهاتفية على الهواتف المحمولة أو الإعلان بالبريد الإلكتروني هو من مسائل الواقع التي تستقل باستخلاصها وتقديرها محكمة الموضوع دون معقب عليها من محكمة التمييز متى أقامت قضاءها على أسباب سائغة لها أصل ثابت بالأوراق. ومن المقرر أيضًا في قضاء هذه المحكمة، إن الأصل في الإجراءات إنها قد روعيت، وعلى من يدعي خلاف ذلك عبء إثبات ما يدعيه، وإن البيانات المتعلقة بالإجراءات التي يثبت الموظف القائم بالإعلان إنه قام بها بنقسه تعتبر بيانات رسمية لا يجوز إثبات عكسها إلا بطريق الطعن بالتزوير على الإعلان. كما أنه من المقرر وفقًا لنص المادتين (153) و(161) من قانون الإجراءات المدنية، وعلى ما جرى به قضاء هذه المحكمة، إن الأصل أن ميعاد الاستئناف ثلاثون يومًا يبدأ من تاريخ إعلان الحكم إلى المحكوم عليه إذا كان قد تخلف عن الحضور في جميع الجلسات المحددة لنظر الدعوى ولم يقدم مذكرة بدفاعه، ويترتب على عدم مراعاة مواعيد الطعن سقوط الحق فيه، وتقضي المحكمة بالسقوط من تلقاء نفسها لتعلقه بالنظام العام. ومن المقرر أيضًا في قضاء هذه المحكمة إنه إذا انتهى الحكم المطعون فيه إلى النتيجة الصحيحة في القانون بتقريرات قانونية خاطئة، يكون لمحكمة التمييز أن تصحح تلك التقريرات الخاظئة دون أن تنقضه. لما كان ذلك، وكان الحكم المطعون فيه قد أقام قضاءه على ما أورده بأسبابه من أن ((الثابت للمحكمة من الاطلاع كافة أوراق الدعوى وعلى نظام التقاضي بمحاكم دبى فيما يتعلق بالملف الإلكتروني الخاص بذلك الاستئناف، وكان الثابت أن المستأنف قد تم إعلانه بالحكم المستأنف بتاريخ 20/2/2023 بواسطة الرسائل النصية الهاتفية على الهاتف المحمول و تم الإرسال من قبل النظام، ومن ثم يكون إعلانه بالحكم المستأنف قد تم صحيحًا ومنتجًا لآثاره القانونية ، سيما وأن المستأنف تم إعلانه بتاريخ 30/12/2022 بصحيفة الدعوى المبتدأة بواسطة الرسائل النصية الهاتفية على الهاتف المحمول وتم الإرسال من قبل النظام، كما الثابت للمحكمة أن المستأنف قام بتاريخ 31/7/2025 برفع منازعة تنفيذ موضوعية قيدت برقم 85 لسنة 2025 بشأن تنفيذ القرار المستأنف، كما قام المستأنف بتاريخ 14/1/2026 بإقامة التماس إعادة النظر رقم 5 لسنة 2026 بشأن القرار المستأنف الصادر بتاريخ 19/1/2023 محل التداعي، ولما كان ميعاد الاستئناف وفق أحكام المادة 161 من قانون الإجراءات المدنية ثلاثون يومًا، وقد تم قيد الاستئناف الماثل بتاريخ 23/3/2026 أي بعد فوات المهلة القانونية المحددة بنص المادة آنفة البيان، وكانت مواعيد الطعن في الأحكام من النظام العام تقضى بها المحكمة من تلقاء نفسها، مما يتعين الحكم بسقوط الحق في الطعن بالاستئناف، وتقضى بسقوط الحق في الطعن بالاستئناف على نحو ما سيرد بالمنطوق.))، ولما كان هذا الذي خلص إليه الحكم المطعون فيه، على نحو ما سلف بيانه، سائغًا ولا مخالفة فيه للقانون، وله أصله الثابت من أوراق الدعوى ومستنداتها، ومؤديًا لما انتهى إليه قضاؤه وكافيًا لحمله وفيه الرد المسقط لما يخالفه، فإن النعي عليه بما ورد بأسباب الطعن لا يعدو أن يكون جدلاً فيما تستقل محكمة الموضوع بتقديره ولا يجوز إبداؤه أمام محكمة التمييز، ومن ثم غير مقبول. 

وحيث إنه لما تقدم، يتعين رفض الطعن. 

فلهذه الأسباب 

حكمت المحكمة برفض الطعن وبإلزام الطاعن المصروفات، مع مصادرة مبلغ التأمين.

بعد الاطلاع على الأوراق وسماع تقرير التلخيص الذي أعده وتلاه بجلسة المرافعة القاضي المقرر/أحمد عبد القوي سلامة وبعد المداولة : ــ حيث إن الوقائع ــ على ما يبين من الحكم المطعون فيه وسائر الأوراق ــ تتحصل في أن المطعون ضدها في الطعن الأول رقم 1908 لسنة 2026 تجاري أقامت الدعوى رقم 2975 لسنة 2025 تجاري جزئي على الطاعنة فيه وأدخلت فيها السيد/ ازهر راوجى بطلب الحكم بإلزامهما بالتضامن بأن يؤديا إليها مبلغ 596,099,40 درهماً والفائدة بواقع 5% منذ تاريخ الاستحقاق وحتى تمام السداد ، وبإعادة شيكي الضمان رقمي ( 274225 ، 274227 ) وكل منهما بمبلغ 305,473 درهماً . وقالت بيانا لذلك إن الطاعنة أسندت إليها إنشاء وتنفيذ مبنى فيلا رقم 1 على قطعة الأرض رقم 6316379 بقيمة تعاقدية بمبلغ 12,218,946 درهماً ، وأنها نفذت الأعمال المسندة إليها على الرغم من وجود مشاكل ومعوقات من جراء عدم التزام الطاعنة بسداد دفعة مستحقة مقدارها 429,714,71 درهماً ، وأنها سبق وأن أقامت دعوى برقم 4309 لسنة 2024 تجاري جزئي للمطالبة بتلك الدفعة وثبت من تقرير الخبرة المنتدبة فيها أحقيتها في تلك الدفعة مع التحفظ باستحقاقها الدفعة النهائية لمخصصات الصيانة بعد انتهاء سنة الصيانة ، وإذ انقضت تلك السنة إلا أن الطاعنة لم تصرف إليها المبلغ المحتجز ومقداره 596,099,40 درهماً ، ولم ترد إليها شيكي الضمان ، وكان الخصم المدخل هو مالك الأرض المقام عليها الفيلا ، ومن ثم كانت الدعوى . وجهت الطاعنة دعوى متقابلة ضد المطعون ضدها بطلب الحكم بإلزامها بأن تؤدي إليها تكلفة إصلاح عيوب تنفيذ أعمال المقاولة بمبلغ 492,526,30 درهماً والفائدة القانونية عنه بواقع 5% من تاريخ المطالبة القضائية وحتى السداد التام ، مع إجراء المقاصة القضائية بينه وبين ما قد يثبت للمطعون ضدها من حقوق . ندب القاضي المشرف خبيراً متخصصاً في الهندسة المدنية ، وبعد أن أودع تقريره ، وبتاريخ 30 ــ 3 ــ 2026 حكمت المحكمة برفض الدعوى المتقابلة ، وفي الدعوى الأصلية بإلزام الطاعنة والخصم المدخل/ ازهر راوجى بأن يؤديا إلى المطعون ضدها مبلغ 467,713,71 درهماً ، والفائدة القانونية بواقع 5% سنوياً من تاريخ الاستحقاق الحاصل في 30 ــ 6 ــ 2025 وحتى السداد ، وبأن يسلماها شيكي الضمان غير المؤرخين رقمي ( 274225 ، 274227 ) بمبلغ 305,437 درهماً لكل منهما والمسحوبين على بنك التجاري الدولي والمبينين وصفاً وقيمة بصحيفة الدعوى وتقرير الخبير ، ورفضت ما عدا ذلك من طلبات . استأنفت الطاعنة والخصم المدخل/ازهر راوجى هذا الحكم بالاستئناف رقم 1910 لسنة 2026 تجاري ، وبجلسة 22 ــ 7 ــ 2026 قضت المحكمة بإلغاء الحكم المستأنف فيما قضى به قبل الخصم المدخل سالف الذكر ، وبتأييد الحكم المستأنف فيما عدا ذلك . طعنت الطاعنة في هذا الحكم بطريق التمييز بالطعن رقم 1908 لسنة 2026 تجاري بموجب صحيفة أودعت مكتب إدارة الدعوى بهذه المحكمة بتاريخ 5 ــ 8 ــ 2026 بطلب نقضه ، قدم محامي المطعون ضده مذكرة جوابية بطلب رفض الطعن ، كما طعنت المطعون ضدها في ذات الحكم بالطعن المقيد برقم 1914 لسنة 2026 تجاري بموجب صحيفة أودعت مكتب إدارة الدعوى تاريخ 10 ــ 8 ــ 2026 بطلب نقضه ، قدمت المطعون ضدها الأولى مذكرة بالرد . وإذ عرض الطعنان في غرفة مشورة ورأت المحكمة أنهما جديران بالنظر حددت جلسة لنظرهما في المرافعة وليصدر فيهما حكماً واحداً للارتباط بجلسة اليوم . 

وحيث استوفى الطعن الأول رقم 1908 لسنة 2026 تجاري شروط قبوله الشكلية . 

وحيث أقيم الطعن على سببين تنعى بهما الطاعنة على الحكم المطعون فيه مخالفة القانون والخطأ في تطبيقه والفساد في الاستدلال والإخلال بحق الدفاع ، وفي بيان ذلك تقول إنها تمسكت في دفاعها أمام محكمة الاستئناف بأنها وجهت إلى المطعون ضدها الخطاب رقم ( WHC/1199/LTR/159/25 ) المؤرخ 15 ــ 5 ــ 2025 بشأن عيوب التنفيذ ، وذلك خلال فترة ضمان العيوب المتفق عليها ومدتها ثمانية عشر شهراً تبدأ من 1 ــ 1 ــ 2024 حتى 30 ــ 6 ــ 2025 ، ومن ثم فلا تستحق الأخيرة مبلغ المحتجزات ( RETENTION ) ومقداره 467,713,17 درهماً لعدم قيامها بمعالجة جميع عيوب التنفيذ الثابتة بتقرير ومراسلات استشاري المشروع ، و قدمت تدليلاً على صحة دفاعها صورة من البريد الإلكتروني المؤرخ 15 ــ 5 ــ 2025 الموجه من استشاري المشروع إلى المطعون ضدها والمعنون ( استمرار تسريب المياه والإخفاق في إصلاح العيوب بشكل صحيح ــ إخطار بموجب بنود عقد " فيديك " ) ، إلا أن الحكم المطعون فيه لم يعن ببحث هذا الدفاع الجوهري ولم يمحص دلالة المستندات المؤيدة له ، وواجهه بما لا يصلح رداً عليه ، هذا إلى أن الحكم عول في قضائه على تقرير الخبير المنتدب في الدعوى رغم تمسكها ببطلانه وقصوره ، ذلك أن الخبير لم يجتمع بها ولا بممثلها القانوني لبحث دفوعها ودفاعها في الدعويين الأصلية والمتقابلة ، كما أنها لم تحضر اجتماع الخبرة المنعقد في الدعوى الأصلية لعدم إخطارها به قبل موعده بوقت كاف بالمخالفة للمدة المقررة قانوناً وهى خمسة أيام عملاً بنص المادة (16/ب) من قانون تنظيم أعمال الخبرة ، فضلاً عن ذلك فقد التفت الخبير عن سائر المطاعن التي وجهتها إلى أعماله ، ولم يأبه بمراسلاتها المتضمنة طلب تحديد موعد للاجتماع به وتمكينها من عرض دفاعها ودفوعها في الدعويين الأصلية والمتقابلة ، كما أعد تقريره المبدئي دون التحقق من طلباتها في الدعوى ، إضافة إلى أنها ــ الطاعنة ــ طلبت من محكمة الاستئناف ندب لجنة خبرة هندسية محاسبية لإعادة بحث عناصر النزاع وتدارك أوجه القصور والبطلان التي شابت أعمال وتقرير الخبير المنتدب في الدعوى إلا أنها التفتت عن هذا الطلب ، وهو مما يعيبه ويستوجب نقضه . 

وحيث إن هذا النعي مردود ، ذلك بأن المقرر ــ في قضاء محكمة التمييز ــ أن عقد المقاولة وعلى ما تفيده المادة 872 من قانون المعاملات المدنية هو عقد يتعهد أحد طرفيه بمقتضاه أن يصنع شيئاً ، أو يؤدي عملاً ، لقاء بدل يتعهد به الطرف الآخر ، وأن تقدير قيام المقاول بتنفيذ عملية المقاولة طبقاً للشروط والمواصفات المتفق عليها وفي الميعاد المحدد للتنفيذ أم لا ، هو مما تستقل بتقديره محكمة الموضوع متى أقامت قضاءها على أسباب سائغة تؤدي إلى النتيجة التي انتهت إليها ، واستخلاص مدى تنفيذ كل طرف من المتعاقدين للالتزامات التي التزم بها في العقد هو مما يدخل في نطاق سلطة محكمة الموضوع متى كان استخلاصها سائغاً له ما يسانده في الأوراق ، وأن لمحكمة الموضوع سلطة فهم الواقع في الدعوى وتقدير الأدلة والمستندات المقدمة فيها والموازنة بينها والأخذ منها بما تطمئن إليه واطراح ما عداها بما في ذلك تقرير الخبير المنتدب في الدعوى والأخذ بالنتيجة التي انتهى إليها محمولة على الأسباب التي بني عليها ــ دون غيرها من الأدلة والمستندات المقدمة من الخصوم ــ وذلك متى اطمأنت المحكمة إلى هذه النتيجة والأسباب التي بُنيت عليها ورأت كفايتها لتكوين عقيدتها في الدعوى مضافاً إليها باقي العناصر المقدمة في الدعوى ، وهي غير ملزمة من بعد أن ترد بأسباب خاصة على كل ما أبداه الخصم من مطاعن على تقرير الخبير أو إجابته إلى طلب ندب خبير آخر أو إعادة المأمورية للخبير السابق ندبه ، لأن في أخذها بالتقرير الذي عولت عليه محمولاً على أسبابه ما يفيد أنها لم تر في دفاع الخصوم ما ينال من صحة النتيجة التي توصل إليها الخبير في تقريره ولا يستحق الرد عليه بأكثر مما تضمنه هذا التقرير ، وطالما أن الخبير قد تناول نقاط الخلاف المثارة بين الطرفين ودلل عليها بأسبابٍ سائغة لها معينها الصحيح من الأوراق ، دون ما حاجة لإلزام الخبير بأن يؤدي المأمورية على وجه معين ، إذ حسبه أن يقوم بها على النحو الذي يراه محققاً للغاية التي ندب إليها ، وطالما أن عمله خاضع في النهاية لتقدير محكمة الموضوع ، وأن مناط بطلان تقرير الخبير هو أن يكون قد شاب إجراءاته عيب جوهري ترتب عليه ضرر للخصم . لما كان ذلك ، وكان الحكم المطعون فيه بما له من سلطة تقديرية ــ قد خلص من أوراق الدعوى ومستنداتها وتقرير الخبير الذي اطمأن إليه إلى أن العلاقة بين الطرفين هي علاقة مقاولة أسندت بموجبها الطاعنة إلى المطعون ضدها إنشاء الفيلا محل النزاع ، وأن الأخيرة نفذت الأعمال وفقاً للمتفق عليه وصدرت شهادة الإنجاز للمشروع ، وتم التسليم الابتدائي وبدأت فترة ضمان الصيانة اعتباراً من 1 ــ 10 ــ 2024 حتى انتهت بتاريخ 30 ــ 6 ــ 2025 وبما يفيد إتمام الأعمال وقبولها ابتدائياً من قبل الاستشاري والمالك ، وأنه لم يثبت إخطار المطعون ضدها بأي عيوب تنفيذية خلال فترة ضمان الصيانة ، عدا بند تسريبات المياه الوارد بتقرير استشاري المشروع المؤرخ 29 ــ 4 ــ 2025 والذي ثبُت أنه العيب الوحيد الذي تم إخطارها به خلال فترة الضمان ، وأن باقي العيوب الواردة بخطابي الاستشاري المؤرخين 17 ــ 7 ــ 2025 ، 6 ــ 10 ــ 2025 فقد تم الإخطار بها بعد فترة الضمان ، ومن ثم فلا تتحمل المطعون ضدها المسئولية عما ورد بهما من عيوب ، وأن تسريبات المياه ترجع إلى عيوب تنفيذية محدودة في نظام تصريف مياه الألمونيوم والعزل المائي وتحديداً في توصيلات وأنابيب التصريف وعدم مطابقتها للمواصفات ، وهو ما ترتب عليه أضرار في بعض التشطيبات الداخلية ، وتتحمل المطعون ضدها مسؤولية هذا البند فقط في حدود ما ثبت فنياً ، حيث قدر الخبير المنتدب تكلفة معالجة العيوب الفنية الخاصة بتسريبات المياه بمبلغ 50,000 درهم ، كما قدر قيمة الأضرار الناتجة عن تلك التسريبات بمبلغ 50,000 درهم أخرى ، ليكون إجمالي المبلغ الواجب خصمه فنياً هو 100,000 درهم ، وأن الطاعنة سددت كامل الدفعات المستحقة للمطعون ضدها وفق شهادات الدفع المعتمدة ، وأن المبلغ المترصد بذمتها ينحصر فقط في قيمة المحتجزات الختامية بنسبة (5%) من قيمة العقد والبالغ مقدارها 567,713,71 درهماً ، وأن إخلالها جزئي متمثل في حجز كامل قيمة المحتجز الختامي وشيكي الضمان رغم ثبوت عيب محدود فقط ، وأن صافى المبلغ المستحق للمطعون ضدها من هذا المحتجز هو مبلغ 467,713,71 درهماً بعد خصم نسبة عيوب تسريبات المياه والأضرار الناجمة عنها والتي قدرها الخبير بمبلغ 100,000 درهم ، فضلاً عن أحقية المطعون ضدها في استرداد شيكي الضمان المقدمين من جانبها ، وأنه لا ينال من ذلك ما أثارته الطاعنة من قيام استشاري المشروع بمخاطبة المطعون ضدها بتاريخ 15 ــ 5 ــ 2025 بوجود عيوب في التنفيذ داخل مدة ضمان العيوب وفشل الأخيرة في معالجة تلك العيوب ، ومما أجبر الطاعنة على معالجة العيوب من خلال مقاولين آخرين بتكلفة مقدارها 1,088,625,70 درهماً ، بعد أن ثبت للمحكمة أن العيوب الواردة بهذين الخطابين لم تخطر بها المطعون ضدها خلال فترة ضمان الصيانة عدا بند تسريبات المياه ، وأن التكلفة المقدمة من الطاعنة لإصلاح العيوب لا ترتبط بالعيب الوحيد الثابت فنياً وهو بند تسريبات المياه ــ محل الخطاب المؤرخ 15 ــ 5 ــ 2025 ــ ولا تتناسب مع طبيعة وحجم الأعمال المطلوبة لمعالجة هذا البند ، وأنه لا يعيب تقرير الخبير ما أثارته الطاعنة من عدم اجتماعها معه في أي مرحلة من مراحل أعمال الخبرة بعد أن ثبت للمحكمة أن تخلفها عن حضور اجتماع الخبرة الأول كان بإرادتها وأنها أرسلت بريد اعتذار عن الحضور ، وأن الخبير منحها مهلة مناسبة لتقديم ما لديها من مستندات ومذكرات شارحة ، وأيضاً رد على اعتراضاتها بمذكرتها المقدمة إليه ورتب على ذلك قضاءه بإلزامها في الدعوى الأصلية بمبلغ 467,713,71 درهماً لصالح المطعون ضدها ، ورفض الدعوى المتقابلة المقامة منها بطلب تكلفة إصلاح الأعمال المعيبة ، ولا يعيب الحكم المطعون فيه التفاته عن طلب ندب خبير آخر وقد وجد في أوراق الدعوى وسائر عناصرها الأخرى ما يكفى للفصل في النزاع ، هذا إلى أن الثابت من تقرير الخبير أنه بتاريخ 26 ــ 5 ــ 2025 أرسل دعوة للطاعنة من خلال البريد الإلكتروني لحضور اجتماع الخبرة الأول المزمع انعقاده بتاريخ 5 ــ 12 ــ 2025 عبر تطبيق زووم ، أي أن الدعوى أرسلت قبل انعقاد الاجتماع بوقت كاف ، وكان هذا الذي خلص إليه الحكم المطعون فيه يقوم على أسباب سائغة لها مأخذها الصحيح من الأوراق وتتضمن الرد الضمني المسقط لكل ما أثارته الطاعنة ، ومن ثم فإن النعي بما ورد بسببي الطعن لا يعدو أن يكون مجرد جدل فيما لمحكمة الموضوع من سلطة تحصيل وفهم الواقع في الدعوى وتقدير الأدلة والمستندات المقدمة فيها ومنها تقرير الخبير ، وهو ما لا تقبل إثارته أمام محكمة التمييز . 

وحيث إنه وعن شكل الطعن الثاني رقم 1914 لسنة 2026 تجاري بالنسبة للمطعون ضدها الأولى ، وكان من المقرر ــ في قضاء هذه المحكمة ــ أن قبول الطعن على الحكم المطعون فيه بطريق التمييز هو من المسائل المتعلقة بالنظام العام وتلتزم المحكمة بالفصل فيها من تلقاء نفسها ولا يصار إلى بحث أسباب الطعن إلا إذا كان مقبولاً ، وأن النص في المادة 151/1 من قانون الإجراءات المدنية رقم 42 لسنة 2022 على أنه لا يجوز الطعن في الأحكام إلا من المحكوم عليه ولا يجوز ممن قبل الحكم صراحةً أو ضمناً أو ممن قضي له بكل طلباته ما لم ينص القانون على غير ذلك . لما كان ذلك ، وكان الحكم المطعون فيه قد قضى للطاعنة بكل طلباتها في مواجهة الشركة المطعون ضدها الأولى ، ومن ثم فإن اختصام الطاعنة لها في الطعن المعروض يكون غير جائز والطعن بالنسبة لها يكون غير مقبول . 

وحيث إن الطعن ــ فيما عدا ما تقدم ــ قد استوفى شروط قبوله الشكلية . 

وحيث أقيم الطعن على سببين تنعى بهما الطاعنة على الحكم المطعون فيه مخالفة القانون والخطأ في تطبيقه وتأويله والفساد في الاستدلال والقصور في التسبيب ، حين قضى برفض الدعوى قبل المطعون ضده واستبعد مسؤوليته عن الدين محل المطالبة ، رغم ثبوت مسؤوليته عنه بموجب الحكم الصادر في الدعوى رقم 2975 لسنة 2025 تجاري دبي الحائز قوة الأمر المقضي فيما فصل فيه من مسؤوليته عن كافة أثار عقد المقاولة مثار النزاع ، وكانت الدعوى الراهنة مطالبة بجزء من مستحقات ذات المقاولة وبين ذات الأطراف ، فضلاً عن سبق صدور أحكام نهائية في شأنها أثبتت انشغال ذمته بالمبالغ الناشئة عنها وألزمته برد شيكات الضمان التي تسلمها بشخصه ووقع على استلامها ، هذا إلى أن الثابت من تقرير الخبير وسائر الأوراق أن المطعون ضده هو رب العمل والمتعاقد ومالك الأرض والفيلا محل عقد المقاولة ، وأنه تعامل بصفته الشخصية واتخذ من الشركة ستاراً للتهرب من إلتزاماته المقاول ، فتعامل برخصة منطقة حرة جبل علي لبناء الفيلا علي الأرض العائده له وكان يقوم بسداد الدفعات من ماله الخاص ، وتولى تكليف الطاعنة بالأعمال ومتابعة تنفيذها وإصدار أوامر العمل الأصلية والاضافية واستلام الأعمال ، كما قام بسداد دفعات من حسابه البنكي الشخصي وأصدر شيكات باسمه للطاعنة ، بما يقطع بمباشرته العلاقة التعاقدية والتزامه بمستحقات المشروع ، إضافة إلى ثبوت قبوله الإحالة من المقاول الرئيسي وتولى التكليف بالأعمال ومتابعة تنفيذها وسداد مبالغ عنها ، وقامت الطاعنة بتنفيذ الأعمال المسندة إليها بموجب عقد المقاولة من الباطن ولم يقدم المطعون ضده الثاني ما يفيد براءة ذمته من الدين بالوفاء أو الانقضاء بأي سبب من أسباب الانقضاء ، بما يؤكد ثبوت صفته التعاقدية ومسؤوليته عن المبلغ المطالب به عملاً بمقتضى نص المادة 891 من قانون المعاملات المدنية ، بما كان يوجب القضاء لها بطلباتها في مواجهته ، إلا أن الحكم المطعون فيه سار على خلاف مقتضى هذا النظر وقضى برفض الدعوى قبله ، وهو مما يعيبه ويستوجب نقضه . 

وحيث إن هذا النعي في غير محله ، ذلك بإنه من المقرر ــ في قضاء هذه المحكمة ــ أن الشركة ذات المسؤولية المحدودة تكتسب شخصيتها الاعتبارية من تاريخ قيدها في السجل التجاري وتظل هذه الشخصية باقية لها إلى حين انقضائها قانوناً ولذلك فإن الشخصية الاعتبارية للشركة تكون مستقلة عن شخصية الشركاء فيها وعن شخصية من يمثلها قانوناً وتظل محتفظة بهذه الشخصية المستقلة عن غيرها ، وأن لكل شركة ما عدا شركة المحاصة ذمة مالية وشخصية اعتبارية مستقلة عن ذمة وشخصية أية شركة أخرى ولذلك فإن آثار التصرفات التي تجريها الشركة لا تتعداها إلى غيرها ، و من المقرر أن مدير الشركة المحدودة المسؤولية لا يسأل في ماله الخاص إلا في حالة ثبوت الغش أو الاحتيال الظاهر بجلاء أو مخالفة القانون أو لنظام الشركة وإدارته لها وإن الغش والاحتيال الظاهر بجلاء لا يفترض بل لابد من الادعاء به وإقامة الدليل عليه ، وأنه وإن كان لكل حكم قضائي قطعي حجية الشئ المحكوم فيه من يوم صدوره ولو كان قابلاً للطعن فيه ، وهذه الحجية تمنع الخصوم من رفع دعوى جديدة بادعاءات تناقض ما قضى به هذا الحكم ولا يجوز معها للمحكمة التي أصدرته ولا لمحكمة غيرها أن تعيد النظر فيما قضى به إذا تمسك الخصم الآخر بحجيته ، إلا أن هذه الحجية مؤقتة وتقف بمجرد رفع استئناف عن هذا الحكم وتظل موقوفة إلى أن يقضى في الاستئناف فإذا تأيد الحكم عادت إليه حجيته ، وإذ ألغى زالت عنه هذه الحجية ، ويترتب على ذلك وقف حجية الحكم نتيجة لرفع الاستئناف عنه ، وأنه من المقرر ــ في قضاء هذه المحكمة ــ أن الحكم الابتدائى لاحجية له أمام جهة الطعن ــ وهى هنا محكمة الاستئناف ــ التي لها أن تقضي بإلغائه أو تعديله أو تأييده ، وقد استقر قضاء هذه المحكمة على أن القصور فى أسباب الحكم القانونية أو الخطأ فيها لا يعيب الحكم ولمحكمة التمييز استكمال تلك الأسباب أو تصحيحها متى كانت النتيجة التى انتهى إليها الحكم صحيحة ، وأنه متى كان الحكم المطعون فيه قد أصاب صحيح القانون في نتيجته فلا يبطله قصوره في الإفصاح عن سنده من القانون إذ لمحكمة التمييز أن تستكمل ما قصر الحكم في بيانه من ذلك . لما كان ذلك ، وكان الثابت بالأوراق ــ وعلى نحو ما حصله الحكم المطعون فيه منها ــ أن عقد المقاولة مثار النزاع مبرم بين شركة مار هولدينجز ليمتد والطاعنة وأن الأخيرة اختصمت المطعون ضده في الدعوى المعروضة باعتباره مالك الفيلا موضوع عقد المقاولة ، وكان البين من الأوراق أن الشركة المشار إليها هي شركة ذات مسؤولية محدودة تتمتع بشخصية اعتبارية مستقلة ، وأن المطعون ضده هو أحد مديرها ، ولم تقدم الطاعنة ما يفيد ارتكابه خطأً جسيماً أو غشاً أو مخالفة للقانون ، أو أنه اتخذ من الشركة ستاراً للتهرب من الوفاء بالتزامات المشروع ، ومن ثم لا يسأل عن تصرفات الشركة في ذمته الشخصية ، وإذ قضى الحكم المطعون فيه بإلغاء الحكم المستأنف والقضاء بعدم قبول تدخل المطعون ضده أمام محكمة أول درجة لإنتفاء صفته في النزاع المعروض ، وهو ما يستوي بحسب المآل مع القضاء برفض الدعوى قبله ، فإنه يكون قد انتهى إلى النتيجة الصحيحة في القانون ، ولا يعيبه قصور أسبابه القانونية والواقعية وقد تكفلت هذه المحكمة بإيراد الأسباب القانونية الصحيحة واستكمالها ، ولا ينال من ذلك تمسك الطاعنة بسبق صدور الحكم في الدعوى رقم 2975 لسنة 2025 تجاري دبي بتقرير وثبوت مسؤولية المطعون ضده عن المبلغ المطالب به ، فإنه ولئن كان الحكم الابتدائي الصادر في الدعوى المشار إليها قد قضى بإلزام شركة مار هولدينجز ليمتد و المطعون ضده بأداء المبلغ المقضى به للطاعنة ، إلا أنه قد تم استئناف هذا القضاء بموجب الاستئناف محل الطعن المطروح ، وقضت محكمة الاستئناف فيه بإلغائه فيما قضى به في مواجهة المطعون ضده وتأييد قضاءئه في خصوص إلزام الشركة المشار إليها وحدها بأداء هذا المبلغ ، فأضحى هذا القضاء الأخير هو الحائز لحجية الأمر المقضي وزالت عن الحكم الابتدائى في شقه الملغي حجيته وآثارة بحسبان أن حجيته كانت موقوفة معلقة على نتيجة الفصل في الاستئناف ، ومن ثم فلا يسوغ أو يجوز للطاعنة ــ وهى المحكوم لها ــ أن تعود إلى التمسك بما قضى به الحكم الابتدائى في شأن إلزام المطعون ضده بعد أن ألغى هذا القضاء بالحكم الاستئنافي المطعون عليه بموجب الطعن الراهن ، ويكون طلبها إلزام المطعون ضده على سند من حجية الحكم الابتدائى مار الذكر فاقداً لسنده ولا يستند إلى أساس قانوني سليم ، والنعي على الحكم المطعون فيه بسببي الطعن يكون على غير أساس . 

وحيث إنه ولما تقدم يتعين رفض الطعنين . فلهذه الأسباب 

حكمت المحكمة : برفض الطعنين رقمى 1908 ، 1914 لسنة 2026 تجاري وبإلزام كل طاعن بمصروفات طعنه ومصادرة التأمين في كلا الطعنين .

أصـدرت الحكـم التـالي

بعد مطالعة الأوراق وسماع تقرير التلخيص الذي أعده وتلاه بجلسة المرافعة القاضي المقرر يحيى الطيب أبوشورة وبعد المداولة: 

حيث استوفى الطعن شروط قبوله الشكلية. 

وحيث تتحصل الوقائع ? على ما يبين من الحكم المطعون فيه وسائر الأوراق -في أن المطعون ضدها الأولى (أيه دي سي لأنظمه الطاقة ش ذم م) أقامت لدى محكمة دبي الابتدائية الدعوى رقم 95 لسنة 2018م تجارى كلى ضد الطاعن (رهيف حنا إبراهيم) والمطعون ضدها الثانية (ايلمك للأعمال الكهروميكانيكية ش ذ م م) بطلب الحكم بإلزامهما متضامنين بأداء مبلغ عشرة ملايين درهم والفائدة القانونية بنسبة 9% سنوياً من تاريخ الاستحقاق والمصروفات، على سند من أن المدعى عليها الاولى قد حررت لصالحها الشيكين المصرفين رقمي(500004-500006) الموقعين من المدعى عليه الثاني كل بقيمة خمسه مليون درهم والمسحوبين من حسابها لدى (مصرف أبو ظبى الإسلامي )والمستحقان الصرف في الاول والخامس من نوفمبر 2018م واللذين ردهما البنك في تاريخ الاستحقاق دون صرف لعدم وجود رصيد مما حدا بها لإقامة الدعوى. بجلسة 4-11-2025م قضت المحكمة بإلزام المدعي عليهما بأن يؤديا للمدعية مبلغ عشرة ملايين درهم والفائدة القانونية بواقع 9% سنويا من تاريخ استحقاق كل شيك وحتى السداد التام والمصروفات. استأنف المدعى عليه الثاني هذا الحكم بالاستئناف رقم 1708 لسنة 2026م تجارى. بجلسة 8-7-2026م قضت المحكمة بسقوط حقه في الاستئناف للتقرير به بعد الميعاد القانوني. طعن المدعى عليه الثاني ( رهيف حنا إبراهيم) على هذا الحكم بالتمييز الماثل بموجب صحيفة أودعت إدارة الدعوى بهذه المحكمة بتاريخ 5-8- 2026م بطلب نقضه. وأودعت المطعون ضدها الاولى مذكره بدفاعها بطلب رفض الطعن. 

وحيث عرض الطعن في غرفة مشوره ورأت المحكمة أنه جدير بالنظر وحددت جلسة لنظره وفيها قررت اصدار الحكم بجلسة اليوم. 

وحيث أقيم الطعن على سبب واحد ينعى به الطاعن على الحكم المطعون فيه مخالفة القانون والخطأ في تطبيقه والقصور في التسبيب والفساد في الاستدلال والاخلال بحق الدفاع ومخالفة الثابت بالأوراق لقضائه بسقوط حقه في الاستئناف لتقديمه بعد فوات ميعاده القانوني تأسيساً على اعلانه بالحكم المستأنف إعلاناً قانونياً صحيحاً بطريق النشر فى الصحف وأن علمه بالحكم المستأنف قد تحقق رغم أن الثابت بأوراق الدعوى أن اجراءات التحري عن عنوانه لإعلانه بالحكم المستأنف قد أسفرت عن ثبوت وجوده خارج الدولة وأن المطعون ضدها الأولى على علم بذلك لقيامها لاحقاً باتخاذ إجراءات التنفيذ ضده في موطنه خارج الدولة بما كان يستوجب عليها اعلانه بالحكم المستأنف على عنوانه خارج الدولة بإرسال الإعلان إلى وزارة العدل لإحالته إلى وزارة الخارجية والتعاون الدولي ليتم إعلانه بالحكم المستأنف بالطرق الدبلوماسية وفقاً لنص المادة ( 6-7) من قرار مجلس الوزراء رقم(75) لسنة 2018م بشأن اللائحة التنظيمية للقانون الاتحادي رقم 11 لسنة 1992م بما يثبت أن إعلانه بالحكم المستأنف لم يكن إعلاناً قانونياً صحيحاً منتجاً لآثاره القانونية بما يثبت أن ميعاد الاستئناف ما زال مفتوحاً وانه قد قيد استئنافه في ميعاده القانوني بما كان يستوجب قبوله شكلاً ونظر موضوعه وهو مما يعيب الحكم المطعون فيه ويستوجب نقضه. 

وحيث إن هذا النعي مردود اذ أن من المقرر -وعلى ما جرى به قضاء هذه المحكمة- سنداً لنص المادة (6) من اللائحة التنظيمية لقانون الإجراءات المدنية الصادرة بقرار مجلس الوزراء رقم (57) لسنة 2018م أن يتم إعلان الشخص المعلن إليه بالمكالمات المسجلة الصوتية أو المرئية أو الرسائل النصية على الهاتف المحمول أو بالبريد الالكتروني أو الفاكس أو ما يقوم مقامها من وسائل التقنية الحديثة التي يصدر بتحديدها قرار من وزير العدل ولشخصه أينما وجد أو في موطنه أو محل إقامته، وفي حال عدم وجود من يصح تسليم الإعلان إليه يتم الاعلان باللصق على الباب الخارجي لمحل إقامته أو في محل عمله، وإذا تعذر إعلان المطلوب إعلانه وفق البند (1) من هذه المادة يعرض الأمر على مكتب إدارة الدعوى أو القاضي المختص أو رئيس الدائرة بحسب الأحوال للتحري عن عنوانه من جهة واحدة على الأقل من الجهات ذات العلاقة ثم إعلائه بالنشر في صحيفة يومية واسعة الانتشار تصدر في الدولة باللغة العربية وبصحيفة أخرى تصدر بلغة أجنبية إن اقتضى الأمر وكان المطلوب إعلانه أجنبياً . وأن من المقرر أن تقدير طريقة الاعلان ومدى كفاية التحريات التي يقوم بها المدعى قبل إعلان خصمه بطريق النشر في الصحف من مسائل الواقع التي تستقل بتقديرها محكمة الموضوع بحسب الظروف المحيطة بواقعة الإعلان طالما أن المحكمة قد أحاطت بما بذله المدعى من جهد في سبيل التوصل لمعرفة موطن الخصم قبل الالتجاء إلى إعلانه بطريق النشر فى الصحف. ، وأن من المقرر -وعلى ما جرى به قضاء هذه المحكمة-سنداً لنص المادتين (152-159) من قانون الإجراءات المدنية لسنة 1992 أن ميعاد الاستئناف ثلاثون يوماً يبدأ من اليوم التالي لتاريخ صدور الحكم المستأنف إذا كان حضورياً ومن تاريخ إعلان الحكم إلى المحكوم عليه إذا كان بمثابة الحضوري، وأن الذي ويترتب على عدم مراعاة مواعيد الطعن في الأحكام سقوط الحق في الطعن وتقضي به المحكمة من تلقاء نفسها لتعلقه بالنظام العام. لما كان ذلك وكان الحكم المطعون فيه قد أقام قضاؤه بسقوط حق الطاعن في الاستئناف على ما أورده في أسبابه بقوله (لما كان الثابت للمحكمة من الاطلاع كافة أوراق الدعوى وعلى نظام التقاضي بمحاكم دبى...أن المستأنف قد تم إعلانه بالحكم المستأنف بطريق النشر بموجب العدد رقم 12638 بتاريخ 22-5-2019م بناء على تصريح القاضي وعقب ورود إفادة التحري وفقا لصحيح القانون ....كما الثابت للمحكمة من قرار قاضى التحقيق فى لبنان بإحالة المستأنف للمحاكمة لتهريبه الأموال التي تم الحجز عليها استنادا للمديونية محل التداعي سند الحكم المستأنف بناء على الشكوى المقدمة من المستأنف ضدها الأولى ضده نفاذا لقيامها باتخاذ إجراءات تنفيذ الحكم بدولة لبنان وثابت بقرار قاضى التحقيق سؤال المستأنف بتاريخ 18-12-2025م عن التهمة المنسوبة إليه ، الأمر الذى يبين للمحكمة بعلم المستأنف بالحكم المستأنف ، ومن ثم يكون إعلانه بالحكم المستأنف قد تم صحيحا ومنتجا لآثاره القانونية ، ولما كان ميعاد الاستئناف ...ثلاثون يوماً ، وقد تم قيد الاستئناف الماثل بتاريخ 6-4-2026م أي بعد فوات المهلة القانونية المحددة بنص المادة آنفة البيان ، وكانت مواعيد الطعن فى الأحكام من النظام العام تقضى بها المحكمة من تلقاء نفسها ، مما يتعين الحكم بسقوط الحق في الطعن بالاستئناف على نحو ما سيرد بالمنطوق.) وكانت أوراق الدعوى ومستنداتها قد خلت مما يثبت تقديم الطاعن لأي مستند يفيد وجوده خارج الدولة في تاريخ التحري عن عنوانه لإعلانه بالحكم المستأنف، وكان القائم بالإعلان قد انتقل الى مقر عمله لإعلانه بالحكم المستأنف بيد أنه قد وجد المقر مغلقاً وعليه لافته بذات اسم الشركة، وكان الثابت تحرى المطعون ضدها الاولى عن عنوانه لدى مجموعة بريد الامارات لإعلانه بالحكم المستأنف ووردت الإفادة بعدم توفر أي بيانات أو عناوين، فيكون هذا الذي خلص اليه الحكم المطعون فيه سائغاً ومستمداً مما له أصل ثابت بالأوراق وكافياً لحمل قضاءه ومتفقاً وتطبيق صحيح القانون ومتضمناً الرد الكافي على كل ما أثاره الطاعن، ويكون النعي عليه بما سلف مجرد جدل موضوعي فيما لمحكمة الموضوع من سلطه في استخلاص ما بذلته المطعون ضدها الاولى من جهد في سبيل التوصل لمعرفة عنوان الطاعن لإعلانه بالحكم المستأنف لشخصه وتعذر ذلك قبل اللجوء إلى إعلانه بطريق النشر في الصحف وهو ما تنحسر عنه رقابة هذه المحكمة متعيناً رده. 

وحيث إنه لما تقدم يتعين رفض الطعن. 

فلهذه الأسباب 

حكمت المحكمة: برفض الطعن وبإلزام الطاعن بمصروفاته ومبلغ ألفي درهم مقابل أتعاب المحاماة للمطعون ضدها الاولى ومصادرة التأمين.
