مادة 149
يَجُوزُ لِلنَّائِبِ الْعَامِّ أَوْ مَنْ يُفَوِّضُهُ مِنْ تِلْقَاءِ نَفْسُهُ أَوْ بِنَاءٌ عَلَى طَلَبِ ذَوِي الشَّأْنِ، ولقاضي التَّحْقِيقَ الْمُخْتَصَّ، عِنْدَ وُجُودٍ أَدَلَّةَ كَافِيَةَ عَلَى جِدِّيَّةِ الْاِتِّهَامِ فِي جِنَايَةٍ أَوْ جُنْحَةُ مُعَاقَبُ عَلَيْهَا بِالْحَبْسِ أَْنْ يَصْدُرُ أَمْرًا مُسَبِّبًا بِمَنْعِ الْمُتَّهَمِ مِنَ السَّفَرِ خَارِجَ الْبِلَادِ أَوْ بِوَضْعِ اِسْمِهِ عَلَى قَوَائِمِ تَرَقُّبِ الْوُصُولِ لِمُدَّةِ سَنَةٍ قَابِلَةٍ لِلتَّجْدِيدَ لِمُدَّةً أَوْ لِمَدَدُ أُخْرَى مُمَاثَلَةٍ، لِأَمْرَ تَسْتَلْزِمُهُ ضَرُورَاتُ التَّحْقِيقَاتِ أَوْ حُسْنُ سَيْرِ إِجْرَاءَاتِ الْمُحَاكَمَةِ، وَضَمَانَ تَنْفِيذٍ مَا عَسَى أَْنْ يُقْضَى بِهِ مِنْ عُقُوبَاتٍ.
وَيَجُوزُ لِلنَّائِبِ الْعَامِّ أَوْ مَنْ يُفَوِّضُهُ مِنْ تِلْقَاءِ نَفْسُهُ أَوْ بِنَاءٌ عَلَى طَلَبٍ كُلَّ ذِي شَأْنِ أَْنْ يَصْدُرُ أَمْرًا مُسَبِّبًا بِالْإِدْرَاجِ عَلَى قَوَائِمِ الْمَمْنُوعِينَ مِنَ السَّفَرِ أَوْ تَرَقُّبُ الْوُصُولِ لِلْمَحْكُومَ عَلَيْهُمِ الْمَطْلُوبَ التَّنْفِيذَ عَلَيْهُمْ، وَالْمُتَّهَمِينَ وَالْمَحْكُومِ عَلَيْهُمْ مِمَّنْ تَطْلُبُ الْجِهَاتِ الْقَضَائِيَّةِ الْأَجْنَبِيَّةِ الْمُخْتَصَّةِ تَسْلِيمَهُمْ أَوْ مُحَاكَمَتُهُمْ.
Article No. 149
The Public Prosecutor or his delegate may, on his own initiative or at the request of the concerned parties, and the competent investigating judge, when there is sufficient evidence of the seriousness of the accusation in a felony or misdemeanor punishable by imprisonment, issue a reasoned order to prevent the accused from traveling outside the country or to place his name on arrival watch lists for a period of one year, renewable for one or more similar periods, for a matter required by the necessities of the investigations or the proper conduct of the trial proceedings, and to ensure the implementation of any penalties that may be imposed.
The Attorney General or his delegate may, on his own initiative or at the request of any interested party, issue a reasoned order to include on the lists of those prohibited from traveling or on arrival watch lists those convicted and wanted for execution, and those accused and convicted whom the competent foreign judicial authorities request be extradited or tried.
