(المادة 3)
يكفل هذا القانون، على وجه الخصوص، المبادئ والحقوق الآتية:
(أ) حق الطفل في الحياة والبقاء والنمو في كنف أسرة متماسكة ومتضامنة وفي التمتع بمختلف التدابير الوقائية، وحمايته من كافة أشكال العنف أو الضرر أو الإساءة البدنية أو المعنوية أو الجنسية أو الإهمال أو التقصير أو غير ذلك من أشكال إساءة المعاملة والاستغلال.
(ب) الحماية من أي نوع من أنواع التمييز بين الأطفال، بسبب محل الميلاد أو الوالدين، أو الجنس أو الدين أو العنصر، أو الإعاقة، أو أي وضع آخر، وتأمين المساواة الفعلية بينهم في الانتفاع بكافة الحقوق.
(ج) حق الطفل القادر على تكوين آرائه الخاصة في الحصول على المعلومات التي تمكنه من تكوين هذه الآراء وفي التعبير عنها، والاستماع إليه في جميع المسائل المتعلقة به، بما فيها الإجراءات القضائية والإدارية، وفقًا للإجراءات التي يحددها القانون.
وتكون لحماية الطفل ومصالحه الفضلى الأولوية في جميع القرارات والإجراءات المتعلقة بالطفولة أيا كانت الجهة التي تصدرها أو تباشرها.
Article 3
This law, in particular, guarantees the following principles and rights:
(a) The child’s right to life, survival and development within a cohesive and supportive family and to enjoy various protective measures, and to be protected from all forms of violence, harm or physical, moral or sexual abuse, neglect, failure or other forms of ill-treatment and exploitation.
(b) Protection from any kind of discrimination between children, on account of place of birth or parents, sex, religion, race, disability, or any other status, and ensuring effective equality between them in the enjoyment of all rights.
(c) The right of the child capable of forming his or her own views to obtain information that enables him or her to form and express such views, and to be heard in all matters concerning him or her, including judicial and administrative proceedings, in accordance with the procedures established by law.
The protection of the child and their best interests shall take priority in all decisions and actions relating to childhood, regardless of the issuing or implementing body.
