مادة رقم 233
يَجِبُ أَنْ تَشْتَمِلَ الْأَوْرَاقُ الَّتِي يَقُومُ الْمُحَضِّرُونَ بِإِعْلَانِهَا عَلَى الْبَيَانَاتِ الْآتِيَةِ:
– تَارِيخُ الْيَوْمِ وَالشَّهْرِ وَالسَّنَةِ وَالسَّاعَةِ الَّتِي حَصَلَ فِيهَا الْإِعْلَانُ.
– بَيَانُ الْقَضِيَّةِ الْمُعْلَنِ بِشَأْنِهَا، وَمَوْضُوعُهَا، وَصِفَةُ الْمُعْلَنِ إِلَيْهِ فِيهَا.
– اسْمُ الْمُحَضِّرِ وَالْمَحْكَمَةِ الَّتِي يَعْمَلُ بِهَا.
– اسْمُ الْمُعْلَنِ إِلَيْهِ، وَلَقَبُهُ، وَمِهْنَتُهُ أَوْ وَظِيفَتُهُ، وَمَوْطِنُهُ، فَإِنْ لَمْ يَكُنْ مَوْطِنُهُ مَعْلُومًا وَقْتَ الْإِعْلَانِ فَآخِرُ مَوْطِنٍ كَانَ لَهُ.
– تَارِيخُ وَمَكَانُ انْعِقَادِ الْإِجْرَاءِ الْمُعْلَنِ بِشَأْنِهِ.
– اسْمُ وَصِفَةُ مَنْ سُلِّمَتْ إِلَيْهِ صُورَةُ الْوَرَقَةِ، وَتَوْقِيعُهُ عَلَى الْأَصْلِ بِالِاسْتِلَامِ.
– تَوْقِيعُ الْمُحَضِّرِ بِاسْمِهِ الثُّلَاثِيِّ عَلَى كُلٍّ مِنَ الْأَصْلِ وَالصُّورَةِ تَوْقِيعًا مَقْرُوءًا.
وَيَصْدُرُ قَرَارٌ مِنْ وَزِيرِ الْعَدْلِ، بِالتَّنْسِيقِ مَعَ الْوَزِيرِ الْمُخْتَصِّ، بِتَحْدِيدِ آلِيَّةِ إِثْبَاتِ تَسَلْسُلِ الْإِعْلَانَاتِ الْهَاتِفِيَّةِ وَالْإِلِكْتُرُونِيَّةِ، وَكَيْفِيَّةِ التَّحَقُّقِ مِنْ وُصُولِهَا.
Article No. 233
The documents that the bailiffs serve must include the following information:
- The date, day, month, year, and hour at which the announcement was made.
- A statement of the case being announced, its subject matter, and the capacity of the person being announced.
- The name of the bailiff and the court he works for.
- The name of the person being notified, his title, his profession or job, and his place of residence. If his place of residence is not known at the time of the notification, then his last known place of residence.
- Date and place of the procedure announced.
- The name and description of the person to whom the copy of the document was delivered, and his signature on the original acknowledging receipt.
- The official signed the minutes with his full name on both the original and the copy, with a legible signature.
A decision is issued by the Minister of Justice, in coordination with the relevant minister, to determine the mechanism for proving the sequence of telephone and electronic notices, and how to verify their arrival.
