للطفل المعاق الحق في التربية والتعليم وفي التدريب والتأهيل المهني في ذات المدارس والمعاهد ومراكز التدريب المتاحة للأطفال غير المعاقين، وذلك فيما عدا الحالات الاستثنائية الناتجة عن طبيعة ونسبة الإعاقة.
وفي هذه الحالات الاستثنائية تلتزم الدولة بتأمين التعليم والتدريب في فصول أو مدارس أو مؤسسات أو مراكز تدريب خاصة، بحسب الأحوال، تتوافر فيها الشروط التالية:
1- أن تكون مرتبطة بنظام التعليم النظامي وبنظام التدريب والتأهيل المهني لغير المعاقين.
2- أن تكون ملائمة لاحتياجات الطفل المعاق وقريبة من مكان إقامته.
3- أن توفر تعليمًا أو تأهيلاً كاملاً بالنسبة لكل الأطفال المعاقين مهما كانت سنهم ودرجة إعاقتهم.
Article 76 bis
A disabled child has the right to education, training, and vocational rehabilitation in the same schools, institutes, and training centers available to non-disabled children, except in exceptional cases resulting from the nature and degree of disability.
In these exceptional cases, the state is obligated to provide education and training in special classes, schools, institutions, or training centers, as the case may be, that meet the following conditions:
1- It must be linked to the formal education system and the vocational training and rehabilitation system for non-disabled people.
2- It should be suitable for the needs of the disabled child and close to his place of residence.
3- To provide full education or rehabilitation for all children with disabilities, regardless of their age or degree of disability.
