(المادة 113)
يعاقب بالحبس مدة لا تقل عن ثلاثة أشهر أو بغرامة لا تقل عن ألف جنيه ولا تزيد على خمسة آلاف جنيه ، كل من أهمل بعد إنذاره طبقًا للفقرة الأولى من المادة (98) من هذا القانون مراقبة الطفل ، وترتب على ذلك تعرضه للخطر في إحدى الحالات المشار إليها في الفقرة الأولى من المادة (98) من هذا القانون .
ويجوز للمحكمة بدلاً من الحكم بإحدى العقوبتين المشار إليهما بالفقرة الأولى من هذه المادة أن تقضي بإخضاع المخالف لبرامج التأهيل والتدريب التي يصدر بتحديدها قرار من الوزير المختص بالشئون الاجتماعية بالتنسيق مع المجلس القومي للمرأة والمجلس القومي للطفولة والأمومة لمدة لا تزيد على ستة أشهر ، وتتابع المحكمة أمر المخالف عن طريق تقرير يقدم لها من الجهة القائمة على تنفيذ برامج التأهيل والتدريب كل شهر لتقرر المحكمة إنهاء البرامج أو إبدالها أو توقيع العقوبة .
Article 113
Anyone who, after being warned in accordance with the first paragraph of Article (98) of this Law, neglects to supervise a child, and this results in the child being exposed to danger in one of the cases referred to in the first paragraph of Article (98) of this Law, shall be punished by imprisonment for a period of not less than three months or by a fine of not less than one thousand pounds and not more than five thousand pounds.
The court may, instead of imposing one of the two penalties mentioned in the first paragraph of this article, order the offender to undergo rehabilitation and training programs determined by a decision of the Minister of Social Affairs in coordination with the National Council for Women and the National Council for Childhood and Motherhood for a period not exceeding six months. The court shall monitor the offender's case through a report submitted to it monthly by the entity responsible for implementing the rehabilitation and training programs, so that the court may decide to terminate the programs, replace them, or impose the penalty.
